isMalicious Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and the operator of isMalicious ("isMalicious," "we," "us," or "our") governing access to and use of the isMalicious website, application programming interfaces ("APIs"), documentation, dashboards, data feeds, and related offerings (collectively, the "Services"). By creating an account, clicking an acceptance button, using an API key we issue, or otherwise using the Services, you agree to these Terms. If you are accepting on behalf of a company or other legal entity, you represent that you have authority to bind that entity, and "you" refers to that entity. 1. Definitions

  • "Account" means the credentials, workspace, or organization record we associate with you to deliver the Services.
  • "Customer Data" means data you (or your systems) submit to the Services, including without limitation indicators you look up, payloads you send to the APIs, and metadata we receive in connection with those requests.
  • "Output" means threat intelligence, scores, labels, reports, blocklists, and other information returned by the Services in response to your use.
  • "Subscription" means a paid or trial plan, usage tier, or other commercial entitlement we make available to you, as described at checkout, in your Account, or in an order form or statement of work we both sign.

2. Eligibility and accounts

You must be at least the age of digital consent in your jurisdiction (and at least thirteen years old) to use the Services. You will provide accurate registration information and keep it current. You are responsible for all activity under your Account and for safeguarding passwords, API keys, tokens, and other credentials. You must notify us promptly at support@ismalicious.com if you suspect unauthorized access. We may refuse registration or suspend an Account that we reasonably believe is compromised, fraudulent, or violates these Terms.

3. License to use the Services

Subject to these Terms and your compliance with them, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license during your Subscription or other authorized use to access and use the Services solely for your internal security, fraud prevention, risk management, and related lawful business purposes. You will not, and will not assist others to: (a) reverse engineer, decompile, or attempt to extract source code or models from the Services except where mandatory law allows; (b) probe, scan, or test the vulnerability of our systems without prior written consent; (c) use the Services to build or train a competing reputation or threat database for commercial redistribution, except to the extent Outputs are used only as integrated into your own security operations; (d) remove or obscure proprietary notices; or (e) resell, lease, or time-share access to the Services unless we expressly permit that in writing (for example, under an enterprise agreement).

4. Plans, fees, and payment

Paid features are offered as described on our website, in-product, at Stripe Checkout, or in a signed order. Fees, billing cycles, taxes, and renewal terms are those shown at purchase or in your Account unless otherwise agreed in writing. Payments may be processed by third-party payment providers (such as Stripe). You authorize us and our payment processors to charge your chosen payment method for all applicable fees. If you fail to pay, we may suspend or terminate access after reasonable notice where required by law. Except as expressly stated at purchase or in a separate agreement, fees are non-refundable. You are responsible for any sales, use, VAT, GST, or similar taxes imposed on your purchase, other than taxes on our net income. We may change the price of Subscriptions prospectively with reasonable advance notice; continued use after the effective date may constitute acceptance.

5. Acceptable use

You will use the Services only in compliance with applicable law and these Terms. Without limiting the foregoing, you agree not to use the Services to:

  • Conduct, facilitate, or conceal cybercrime, fraud, harassment, stalking, or illegal surveillance of individuals without lawful authority.
  • Violate privacy rights, intellectual property rights, or contractual obligations of any third party.
  • Send malware, conduct denial-of-service attacks against third parties, or distribute unlawful content.
  • Misrepresent the origin of traffic, forge headers, or otherwise impersonate another person or entity in connection with the Services.
  • Use Outputs as the sole basis for automated decisions that have legal or similarly significant effects on individuals where such use would be unlawful without appropriate safeguards—we provide intelligence aids, not legal determinations.
  • Circumvent technical limits, rate limits, access controls, or billing mechanisms, or access data you are not authorized to access.

We may investigate suspected violations and cooperate with law enforcement as required or permitted by law. We may throttle, suspend, or terminate access for conduct that we reasonably believe violates this section or creates risk to us, other customers, or third parties.

6. API usage, rate limits, and fair use

API access is subject to documented and in-product limits (including per-second and per-day quotas) for your plan. We may introduce or adjust limits to protect stability and fairness. You will not use excessive or abusive automation that degrades the Services for others. If you need higher limits, you must upgrade your plan or contact sales. We do not guarantee uninterrupted API availability and may perform maintenance with or without notice, using commercially reasonable efforts to minimize disruption where practicable.

7. Customer Data; license to us; feedback

As between you and isMalicious, you retain ownership of your Customer Data. You represent that you have all rights and consents needed to submit Customer Data and that doing so does not violate law or third-party rights. You grant us a worldwide, royalty-free license to host, process, transmit, display, and otherwise use Customer Data only as reasonably necessary to provide, secure, improve, and analyze the Services (including abuse prevention, quality assurance, and aggregated or de-identified analytics that do not identify you). If you provide suggestions, ideas, or feedback about the Services, we may use them without obligation or compensation to you.

8. Our data, Outputs, and intellectual property

isMalicious and its licensors own the Services, the underlying threat intelligence datasets, software, branding, and documentation, including all intellectual property rights therein. Except for the limited license in Section 3, no rights are granted to you. Outputs are licensed for your use in accordance with these Terms and your plan; you may not publicly republish our bulk data products or APIs as a substitute for your own customers' direct relationship with us where doing so would effectively redistribute our commercial offering, unless we expressly allow it in writing. Threat intelligence is inherently probabilistic and may change over time; you are responsible for how you operationalize Outputs in your environment.

9. Third-party services

The Services may integrate with or link to third-party websites, identity providers, payment processors, or infrastructure. Those third parties are not under our control. Their terms and privacy policies apply to your use of their offerings. We do not endorse third-party content and are not responsible for it.

10. Beta features and changes

We may offer preview or beta features. They are provided as-is, may be unstable, and may be withdrawn at any time. We may modify, deprecate, or discontinue parts of the Services with reasonable notice when practicable; for material adverse changes to paid Subscriptions, we will use commercially reasonable efforts to notify you in advance (for example via email or in-product notice). Nothing in these Terms obligates us to continue supporting any particular feature indefinitely.

11. Disclaimers

THE SERVICES AND OUTPUTS ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT OUTPUTS WILL BE COMPLETE, ACCURATE, OR SUITABLE FOR ANY PARTICULAR DECISION. THREAT INTELLIGENCE MAY INCLUDE FALSE POSITIVES OR FALSE NEGATIVES. YOU USE THE SERVICES AT YOUR OWN RISK AND SHOULD MAINTAIN INDEPENDENT CONTROLS AND HUMAN REVIEW WHERE APPROPRIATE.

12. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, NEITHER ISMALICIOUS NOR ITS AFFILIATES, SUPPLIERS, OR LICENSORS WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO THE SERVICES OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICES IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY, OR (B) ONE HUNDRED U.S. DOLLARS (USD $100) IF YOU HAVE NOT HAD PAYMENT OBLIGATIONS TO US IN THAT PERIOD. THESE LIMITS APPLY WHETHER THE CLAIM IS BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER THEORY. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE CASES OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

13. Indemnification

You will defend, indemnify, and hold harmless isMalicious and its affiliates, officers, directors, employees, and agents from and against any third-party claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your Customer Data or your use of the Services in violation of these Terms or law; (b) your combination of the Services with products or data not provided by us; or (c) a dispute between you and your users or customers. We may assume exclusive defense and control of any matter subject to indemnification at your expense, and you will cooperate with our reasonable requests.

14. Privacy

Our collection and use of personal information is described in our Privacy Policy. The Privacy Policy is incorporated by reference solely with respect to personal data practices. In the event of a conflict between these Terms and the Privacy Policy on a privacy-specific point, the Privacy Policy controls for that point. Enterprise customers processing personal data on behalf of others may require a separate data processing agreement; contact us to discuss.

15. Suspension and termination

You may stop using the Services at any time. We may suspend or terminate your access immediately if we reasonably believe you have materially breached these Terms, if we must comply with law, or if continued provision would create undue risk. Upon termination, your right to use the Services ceases. Sections that by their nature should survive (including intellectual property, disclaimers, limitation of liability, indemnification, and governing law) will survive. We may delete or retain Customer Data in accordance with our retention practices and the Privacy Policy; you should export any data you need before termination where the product allows.

16. Changes to these Terms

We may update these Terms from time to time. We will post the revised Terms on this page and update the "Last updated" date. If a change is material and you have a paid Subscription, we will make reasonable efforts to provide additional notice (such as email or an in-product alert). Your continued use of the Services after the effective date of changes constitutes acceptance. If you do not agree, you must stop using the Services before the effective date. For changes required by law, those changes may be effective immediately upon posting.

17. General

  • Governing law. These Terms are governed by the laws of the jurisdiction in which the operator of isMalicious primarily operates its business, without regard to conflict-of-law principles. Nothing in these Terms limits non-waivable statutory rights you may have as a consumer under the laws of your country or region of residence.
  • Disputes. Except where prohibited by law, you and isMalicious agree that exclusive jurisdiction and venue for disputes arising out of these Terms or the Services will lie in the courts located in that same jurisdiction, unless mandatory law requires otherwise.
  • Export. You will comply with applicable export control and sanctions laws. You represent that you are not located in, or ordinarily resident in, a country or region subject to comprehensive embargoes where use of the Services would be prohibited, and that you are not on any government restricted-party list to the extent relevant to your use.
  • Assignment. You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms in connection with a merger, acquisition, corporate reorganization, or sale of assets.
  • Entire agreement. These Terms, together with the Privacy Policy and any order form or enterprise agreement you sign with us, constitute the entire agreement regarding the Services and supersede prior understandings on the same subject.
  • Severability; waiver. If any provision is held unenforceable, the remaining provisions remain in full effect. Our failure to enforce a provision is not a waiver of our right to do so later.
  • Force majeure. We are not liable for delay or failure to perform due to events beyond our reasonable control, including acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.
  • Independent contractors. The parties are independent contractors. Nothing in these Terms creates a partnership, joint venture, or agency relationship.
  • Notices. We may provide notices via email to the address associated with your Account, via the Services, or by posting on our website. Legal notices to us should be sent to contact@ismalicious.com with a clear subject line referencing these Terms.
